General Terms and Conditions (GTC)

§ 1 Scope, Organizer

(1) These General Terms and Conditions (GTC) apply to all travel contracts concluded between the customer and the organizer:

(2) The organizer is registered as a tour operator and has customer money protection in accordance with § 651r of the German Civil Code (BGB).

§ 2 Conclusion of Contract

(1) The travel descriptions on the website and in the travel confirmation constitute the basis of the contract. Verbal agreements by employees or representatives of the organizer only become binding upon written confirmation.

(2) The contract is concluded upon acceptance by the organizer. Acceptance does not require any particular form. Receipt of the booking confirmation by the customer is decisive.

(3) The contract partner is exclusively the organizer. If the booking is made for additional persons, the person making the booking is liable for their contractual obligations as for their own, provided they have assumed such obligation through an express and separate declaration.

§ 3 Services, Changes to Services

(1) The type and scope of contractual services are determined by the service description on the website, the booking confirmation, and any additional agreements.

(2) The organizer reserves the right to change the agreed travel services if this is necessary due to force majeure, official orders, weather conditions, or other important reasons and the overall nature of the trip is not affected.

(3) Significant changes to essential travel services must be communicated to the customer immediately after becoming aware of the reason for the change. In the event of a significant change, the customer can either accept the change or withdraw from the contract free of charge.

§ 4 Prices and Payment Terms

(1) The prices stated on the website are binding. They are per person and include the services described in each case.

(2) After conclusion of the contract, a deposit of 30% of the travel price is due. The balance payment is due 30 days before the start of the trip. For bookings within 30 days before the start of the trip, the full travel price is immediately due.

(3) If more than four months lie between conclusion of the contract and the agreed travel date, the organizer may increase the agreed travel price in the event of an increase in transportation costs, charges for certain services (e.g., port fees, airport fees), or exchange rates relevant to the trip by the corresponding amount. However, a price increase is only permissible until the 20th day before the start of the trip.

(4) In the event of price increases exceeding 8% of the travel price, the customer is entitled to withdraw from the contract or to request participation in an at least equivalent alternative trip.

§ 5 Customer Cancellation, Cancellation Fees

(1) The customer may withdraw from the travel contract at any time before the start of the trip. The withdrawal must be declared to the organizer. Receipt of the withdrawal declaration by the organizer is decisive.

(2) If the customer withdraws from the contract or does not commence the trip, the organizer may demand reasonable compensation. The amount of compensation depends on the timing of the withdrawal and is:

Up to 60 days before the start of the trip:30% of the travel price
59 to 14 days before the start of the trip:60% of the travel price
Less than 14 days before the start of the trip:90% of the travel price

(3) The customer reserves the right to prove that the organizer has incurred no damage at all or substantially less damage than the flat rate demanded.

(4) The organizer strongly recommends taking out travel cancellation insurance as well as insurance to cover repatriation costs in the event of accident or illness.

§ 6 Rebookings

(1) A rebooking is defined as any change to the travel date, destination, accommodation, or type of board.

(2) Rebooking requests are only possible if the corresponding capacities are available. A processing fee of €75.00 per person is charged for each rebooking.

(3) Rebookings are possible up to 45 days before the start of the trip. After that, the cancellation fees according to § 5 Para. 2 apply.

§ 7 Substitute Person

(1) The customer may request that a third party assume the rights and obligations under the travel contract instead of them, provided this person fulfills all contractual conditions.

(2) The nomination must be communicated to the organizer at least 7 days before the start of the trip.

(3) The customer and the substitute person are jointly and severally liable for the travel price and any additional costs arising from the entry of the substitute person.

§ 8 Withdrawal and Termination by the Organizer

(1) The organizer may withdraw from the contract before the start of the trip if the minimum number of participants specified in the advertisement (6 persons) is not reached. The withdrawal must be communicated to the customer at least 21 days before the start of the trip.

(2) The organizer may withdraw from or terminate the contract if the customer, despite being given a reasonable deadline with threat of termination, fails to make the payments due.

(3) The organizer may terminate the contract without observing a deadline if the customer persistently disrupts the execution of the trip or behaves in such a way that is contrary to the contract that immediate termination of the contract is justified.

(4) In the event of justified withdrawal or termination by the organizer, the travel price paid will be refunded. The customer has no further claims.

§ 9 Service and Travel Defects

(1) If the trip is not provided free from travel defects, the customer may demand remedy. The organizer may refuse remedy if it requires disproportionate effort.

(2) The customer is obliged to report any defect that has occurred immediately to the organizer or tour leader and to request remedy within a reasonable period.

(3) If the customer culpably fails to report a defect, no claim for price reduction arises. The claim for damages remains unaffected unless the organizer would not have been able to provide remedy even without notification of the defect.

(4) If a trip is significantly impaired as a result of a defect, the customer may terminate the contract. The same applies if continuation of the trip cannot be reasonably expected of the customer for an important reason recognizable to the organizer.

§ 10 Limitation of Liability

(1) The contractual liability of the organizer for damages that are not bodily injuries is limited to three times the travel price, insofar as damage is caused neither intentionally nor through gross negligence.

(2) For all claims for damages by the customer arising from unlawful acts that are not based on intent or gross negligence, the organizer is liable for property damage and financial losses up to three times the travel price.

(3) The liability limitations do not apply to claims provided under the Montreal Convention.

(4) The organizer is not liable for service disruptions that occur in the provision of third-party services (e.g., bicycle rental, excursions) and that were neither foreseeable nor preventable by the organizer.

§ 11 Information Obligations Regarding the Identity of the Operating Air Carrier

If flights are part of the travel service, the customer will be informed about the identity of the operating air carrier in accordance with EU regulations. Changes will be communicated immediately.

§ 12 Passport, Visa, and Health Regulations

(1) The organizer informs the customer about general passport and visa requirements as well as health police formalities of the destination country.

(2) The customer is personally responsible for obtaining all travel documents necessary for the trip, obtaining required vaccinations, and observing health regulations.

(3) All disadvantages arising from non-compliance with these regulations are at the customer's expense, except where they are due to culpable incorrect or non-information by the organizer.

§ 13 Special Requirements for Road Cycling Tours

(1) Participation in the road cycling tours requires sufficient physical fitness and experience in road cycling. The customer is personally responsible for ensuring that their health and fitness are sufficient for the planned tours.

(2) The customer is obliged to use a roadworthy bicycle and to comply with road traffic regulations as well as the instructions of the tour leader.

(3) Participation in the road cycling tours is at one's own risk. The organizer is not liable for accidents or damages caused by the participant's own misconduct.

(4) Wearing a helmet is strongly recommended and may be prescribed as mandatory by the organizer.

§ 14 Insolvency Protection (Customer Money Protection)

(1) The organizer has customer money protection in accordance with § 651r BGB with:

(2) The certificate of protection is sent to the customer with the booking confirmation.

(3) In the event of insolvency of the organizer, payments already made for travel services not yet provided will be refunded and costs for necessary repatriation will be covered.

§ 15 Data Protection

The collection, processing, and use of the customer's personal data is carried out exclusively within the framework of the statutory provisions of the EU General Data Protection Regulation (GDPR). Further information can be found in our privacy policy on the website.

§ 16 Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at https://ec.europa.eu/consumers/odr.

(2) The organizer is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 17 Final Provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The place of jurisdiction for all disputes arising from the contractual relationship is, insofar as legally permissible, the registered office of the organizer.

(3) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected.
